GENERAL WARRANTY EXTENSION CONDITIONS<\/span><\/strong><\/h4>\n1. CONTRACTUAL REGULATIONS<\/strong>\nThe warranty extension offered by Newstone is governed by the following General Conditions, by the Warranty Extension Form and by the Warranty Replacement Request Form, recalling in any case what is regulated between the parties in the General Conditions of Sale of Newstone products, as well as, for anything not expressly provided for, by the rules laid down by the Civil Code.
\n\n2.OBJECT OF THE CONTRACT<\/strong>\nWith this contract, Newstone Srl undertakes free of charge to extend the warranty on its products. This warranty service will be carried out in accordance with the agreements and conditions set out in this contract and its annexes, as well as in accordance with the General Conditions of Sale.\nThis warranty covers manufacturing defects of Newstone products and is mandatorily subject to the condition that the installation of Newstone products has been carried out by Installers certified by Newstone Srl.
\n\n3.EFFECTIVENESS AND DURATION OF THE CONTRACT<\/strong>\nThis warranty extension agreement will be considered finalized from the moment of receipt by Newstone of the attached Request Form, duly completed and signed in its entirety and sent by priority mail to Newstone\n\nFailing this, the guarantee will not be activated, the service offered will not be provided.\nThis contract will run from the expiry date of the guarantee pursuant to the law, granting continuity of support, for a period of ten years and by the certified Installer.
\n\n4. CONTRACT FREE<\/strong>\nExcept as provided in the following article, Newstone’s free commitment to extend the warranty on its products is aimed exclusively in favor of Customers who have chosen to install their products by means of Newstone Certified Installers.
\n\n5. WARRANTY EXCLUSIONS<\/strong>\nThis warranty does not cover damage resulting from:\n– construction settlements or other movements of the wall;\n– contact with chemicals or paints;\n– discoloration caused by airborne contaminants;\n– dirt or oxidation;\n– natural color variations due to exposure to the sun and atmospheric agents;\n– reasons of force majeure such as exceptional natural events (floods, earthquakes, lightning, etc.) or nuclear disasters, acts of terrorism, war, piracy, riots and the like, acts of sabotage and burglary, vandalism even if committed to other purposes;\n– even considering that Newstone recommends its Customers to use, where necessary, the appropriate cleaning products (Newstone Cleaner, Newstone Disincrogel) according to the instructions for use indicated on the same, this warranty does not cover damage resulting from non-compliance correct use of the aforementioned detergents and \/ or damage resulting from the use of cleaning products other than those recommended by Newstone;\n– the labor costs for the removal and replacement of defective products are excluded from this contract and must therefore be the subject of a separate and specific agreement on the basis of the rates in force. The parts to be replaced will be collected by Newstone or by third parties appointed by the same and will become the property of Newstone, while the replaced parts will become the property of the Customer, recognizing on them only the guarantee pursuant to the law provided for.\n\n5.1 Transfer of ownership<\/strong>\nThis warranty is effective only in respect of the original purchaser who signed the guarantee itself and lapses in the event of transfer of ownership to a second owner, without the original purchaser being entitled to anything for the unused warranty period.
\n6. METHOD OF ASSISTANCE SERVICES\u00a0<\/strong>\nTo request the replacement of Newstone products, the Customer must send the attached Warranty Replacement Request Form, duly completed and accompanied by the payment receipt.
\n\n7. EXCLUSIONS OF LIABILITY\u00a0<\/strong>\nEven pending the gratuitousness of this contract, in any case Newstone cannot be called to answer for direct or indirect damages caused to the Customer by the execution of the services of assistance, repair and \/ or restoration of Newstone products or in the case of damages deriving from delay in providing you.\nIn particular, Newstone cannot be held responsible for damage caused to third parties that are not directly attributable to it. Likewise, Newstone cannot be held responsible for any damage caused to the Customer for the non-use of the goods in which the Newstone products are incorporated, for the entire period of time necessary to carry out assistance, repairs or replacements.\nWithout prejudice to the provisions of these General Conditions regarding Newstone’s liability exclusions, the parties hereby agree that, should Newstone’s liability be ascertained, such liability cannot exceed the price of the replaced and \/ or repaired products. under warranty, however excluding further compensation and \/ or indemnities for any reason and \/ or reason.
\n\n8. SOLVE ET REPETE<\/strong>\nThe Customer will not be able to initiate any legal action if he does not give proof that he has fulfilled his obligations and in particular that relating to the full payment of the costs and charges excluded from this warranty extension and, in particular, the labor costs for the removal. and the replacement of defective products, as well as any other charges, expenses and costs that may be borne by the Customer.
\n\n9. GOVERNING LAW AND JURISDICTION<\/strong>\nThis Agreement is governed by Italian law and must be interpreted in accordance with the same law. For any dispute that may arise between the Parties, the Court of Reggio Emilia will be competent.
\n\n10. APPROVAL OF CLAUSES<\/strong>\nThe Parties declare that they have read the exact content of all the clauses of this Agreement, acknowledge that they have freely and fully negotiated between them, and that they have specifically approved them as a whole.
\n11. MODIFICATION AND TRANSFER OF THE CONTRACT<\/strong>\nThese General Conditions consist of n. 1 page, in addition to the attachments referred to therein and cannot be modified except by means of another written document, signed by both parties.\nAny mandatory conditions imposed by law or by provisions of Public Authorities or other competent subjects are automatically incorporated into the Contract; likewise, the clauses of the Contract that are incompatible with said mandatory conditions are implicitly abrogated. & lt;\nIn the event of a declaration of ineffectiveness or nullity by the judicial authority in relation to one or more non-essential contractual clauses, the Contract will continue, for the remaining clauses, to be effective between the parties who are obliged to take action to settle any gaps that might arise from this declaration.
\n12. PROTECTION OF PERSONAL DATA<\/strong>\nThe personal data provided for the purpose of executing this Agreement will be subject to computer or manual processing by the contractors in compliance with the provisions of Legislative Decree June 30, 2003 n. 196, exclusively for the purposes related to the execution of this Agreement.
